The law governing homicide is primarily contained in Chapter XVI (Sections 299 to 331) of the Pakistan Penal Code, 1860 (PPC). These provisions define different categories of homicide, prescribe punishments, regulate compensation to victims’ families, and determine when forgiveness or compromise may legally affect criminal proceedings.

Meaning of Qatl

Section 299 PPC defines Qatl as causing the death of a human being.

Although this definition appears straightforward, determining criminal liability is often far more complicated. Whenever one person’s act results in another person’s death, courts must examine several important factors before determining the nature of the offence.

Among the questions commonly considered are:

• Was the death intentional?

• Did the accused know that death was likely to occur?

• Was the death caused by negligence or accident?

• What was the nature of the weapon used?

• What were the surrounding circumstances?

• What does the available evidence reveal about the accused’s state of mind?

The answers to these questions determine the category of homicide and the punishment prescribed by law.

Why the Law Recognizes Different Types of Homicide

Not every unlawful death deserves the same punishment.

A person who carefully plans and intentionally commits murder cannot be treated in the same manner as a driver whose careless conduct unintentionally causes a fatal accident. Likewise, someone who intends only to cause hurt occupies a different legal position from someone whose clear objective is to kill.

For this reason, Pakistani law classifies homicide into different categories according to the offender’s intention, knowledge, and conduct.

The principal categories are:

• Qatl-i-Amd (Intentional Murder)

• Qatl Shibh-i-Amd (Quasi-Intentional Homicide)

• Qatl-i-Khata (Homicide by Mistake)

• Qatl-bis-Sabab (Death Caused Indirectly)

Each category carries different legal consequences.

Qatl-i-Amd (Intentional Murder)

Qatl-i-Amd is defined under Section 300 PPC and represents the most serious form of homicide.

A person commits Qatl-i-Amd when death is intentionally caused. Since intention usually exists only in the mind of the offender, courts determine intention by examining the surrounding circumstances rather than relying solely upon direct evidence.

For example, intention may be inferred where the accused:

• Uses a firearm or another deadly weapon.

• Deliberately attacks vital parts of the body.

• Repeatedly assaults the victim.

• Makes threats before committing the offence.

• Plans the offence in advance.

• Continues the assault despite opportunities to stop.

The number of injuries, the nature of the weapon, previous hostility between the parties, medical evidence, and post-occurrence conduct all assist the court in determining whether intentional murder has been committed.

Motive and Intention

Many people confuse motive with intention. Motive explains why a person commits a crime. Intention explains the deliberate decision to perform the criminal act.

Suppose two neighbours have argued for years regarding a property dispute. One day, one neighbour intentionally shoots the other. The long-standing dispute may establish motive, but the act of deliberately firing establishes intention.Even where motive remains uncertain, reliable eyewitness testimony or scientific evidence may still establish guilt beyond reasonable doubt.

Transfer of Intention

Pakistani law also recognizes the doctrine of transferred intention.

Suppose A intends to kill B and fires a pistol towards him. The bullet misses B but strikes C, who dies as a result.

Although A never intended to kill C, the law treats him as having intentionally caused C’s death because his unlawful intention transfers to the actual victim.

This principle prevents offenders from escaping criminal liability merely because the intended victim survived while another person lost his life.

Punishment for Qatl-i-Amd

Section 302 PPC provides several possible punishments.

Depending upon the facts and legal requirements, the Court may award:

• Death as Qisas.

• Death as Ta’zir.

• Imprisonment for life.

• Other punishment prescribed by law where applicable.

Thus, every murder conviction does not necessarily result in capital punishment.

Understanding Qisas

The word Qisas literally means retaliation or equal recompense.

In Pakistani criminal law, it represents a legal right belonging to the lawful heirs of the deceased.

However, only a competent criminal court may determine guilt and impose punishment after conducting a lawful trial. The legal heirs cannot punish an accused person themselves.

Who is a Wali?

The Wali is the lawful heir entitled to exercise rights relating to Qisas and Diyat.

Where several legal heirs exist, each may possess legal rights according to Islamic law and the Pakistan Penal Code.

Correct identification of all legal heirs is therefore an important aspect of many homicide cases.

Diyat – Financial Compensation

Another distinctive feature of Pakistani law is Diyat. Diyat is financial compensation payable to the lawful heirs of the deceased in circumstances prescribed by law.

Contrary to popular belief, Diyat is not a price placed upon human life. Rather, it is a legally recognized form of compensation intended to provide financial relief where the statutory requirements are fulfilled.

The amount of Diyat is determined according to statutory provisions and is notified periodically by the Federal Government.

Waiver (Afw)

The Pakistan Penal Code permits lawful heirs, in appropriate circumstances, to waive the right of Qisas. This waiver is known as Afw.

The law encourages mercy where appropriate but also recognizes that complete forgiveness should not undermine public confidence in the criminal justice system.

Compromise (Sulh)

Instead of insisting upon Qisas, the lawful heirs may enter into a lawful compromise with the offender. This settlement is known as Sulh. Such compromise may involve payment of compensation agreed between the parties.

However, compromise alone does not automatically terminate every criminal case because courts must also examine the interests of society.

Fasad-fil-Arz – Protection of Society

One of the most important concepts in Pakistani criminal law is Fasad-fil-Arz, which refers to serious disorder or corruption affecting society.

Certain murders are so brutal, so shocking, or so harmful to public order that allowing complete immunity merely because legal heirs have forgiven the offender would undermine public confidence in the justice system.

Accordingly, even where compromise has taken place, courts may still impose punishment if the offence has seriously disturbed public peace or endangered society.

This principle has become especially important in honour killing cases and other crimes involving exceptional brutality.

Other Forms of Homicide

Pakistani law recognizes additional categories of homicide where death occurs without the intention required for Qatl-i-Amd.

Qatl Shibh-i-Amd occurs where the accused intends to cause bodily injury but does not intend death, and death nevertheless occurs.

Qatl-i-Khata covers deaths caused by mistake or accident without criminal intention.

Qatl-bis-Sabab applies where death results indirectly from an unlawful act, even though the accused never intended to kill anyone.

These distinctions ensure that punishment remains proportionate to the offender’s actual level of blameworthiness.

Investigation of Murder Cases

Every successful murder prosecution depends upon a thorough and impartial investigation.

Immediately after receiving information regarding a homicide, police/investigating officers generally:

• Register the First Information Report (FIR).

• Secure the crime scene.

• Collect physical evidence.

• Recover weapons.

• Record witness statements.

• Arrange medico-legal examination.

Modern investigations increasingly depend upon forensic science, including DNA profiling, fingerprint examination, ballistic analysis, CCTV footage, mobile phone records, and digital evidence.

Scientific evidence frequently provides greater reliability than oral testimony alone.

Medical Evidence

Medical evidence occupies a central position in homicide trials.

A post-mortem examination assists the Court in determining:

• Cause of death.

• Time of death.

• Nature of injuries.

• Possible weapon used.

• Sequence of injuries.

Medical findings often confirm or contradict eyewitness testimony and therefore play an important role during trial.

Burden of Proof

The burden of proving guilt always rests upon the prosecution. Every accused person is presumed innocent until proven guilty beyond reasonable doubt. Where reasonable doubt exists, the benefit of that doubt must ordinarily be given to the accused.

This principle remains one of the cornerstones of criminal justice in Pakistan.

Rights of the Accused and Victims

Justice requires protection of both victims and accused persons.

Victims deserve:

• Effective investigation.

• Fair prosecution.

• Respect and dignity.

• Access to justice.

Similarly, every accused person enjoys:

• The right to legal representation.

• The right to a fair trial.

• The right to cross-examine witnesses.

• The right to produce defence evidence.

• The right to appeal.

A balanced criminal justice system protects both sets of rights.

Common Misconceptions

Several misconceptions frequently arise regarding murder law.

The first is that every murder automatically attracts the death penalty.

The second is that every murder case can be privately settled.

The third is that eyewitness testimony always determines the outcome.

Modern criminal litigation increasingly relies upon scientific evidence, forensic reports, electronic records, and careful judicial scrutiny of all available material.

The Code classified unlawful killings into two principal categories:

Culpable Homicide
Murder

This distinction was based primarily on the offender’s intention, knowledge, and surrounding circumstances.

After the partition of the Indian subcontinent in 1947, Pakistan adopted the IPC almost unchanged under the name Pakistan Penal Code, 1860, making it the principal criminal statute governing offences throughout the country.

The Early Years of Pakistan (1947–1979)

For several decades after independence, Pakistan continued to apply the homicide provisions inherited from the colonial legal system.

During this period:

murder remained a crime prosecuted by the State;
punishment depended upon judicial determination;
compromise between private parties generally did not terminate criminal liability;
English common law principles continued to influence judicial interpretation.

Although Pakistan became an independent Muslim state, its criminal justice system remained substantially based on colonial legislation.

Constitutional Developments and Islamization

A significant constitutional shift occurred with the adoption of the Constitution of 1973.

Article 227 of the Constitution provides that all existing laws shall be brought into conformity with the Injunctions of Islam as laid down in the Holy Qur’an and Sunnah.

This constitutional mandate initiated extensive debate regarding whether the existing provisions relating to homicide and bodily injuries were consistent with Islamic criminal jurisprudence.

The Role of the Federal Shariat Court

The establishment of the Federal Shariat Court marked a turning point in Pakistan’s criminal law.

Several petitions challenged the homicide provisions of the Pakistan Penal Code on the ground that they did not conform to Islamic principles governing:

Qisas
Diyat
waiver (Afw)
compromise (Sulh)

The Qisas and Diyat Ordinance, 1990

In response to the constitutional and judicial developments, the Government promulgated the Qisas and Diyat Ordinance, 1990.

Instead of merely changing punishments, the Ordinance fundamentally redefined the legal philosophy underlying homicide.

Among its major innovations were:

replacement of colonial terminology with Islamic legal concepts;
introduction of statutory definitions such as Qatl, Qisas, Diyat, Arsh, Daman, Wali, and Ta’zir;
recognition of the rights of the legal heirs (Wali);
introduction of the concepts of waiver and compromise;
establishment of multiple categories of unlawful homicide;
incorporation of Islamic principles relating to bodily injuries and compensation.

A Shift in Legal Philosophy

The reforms transformed the conceptual basis of homicide law.

Under the colonial model:

homicide was principally regarded as an offence against the State;
punishment was largely controlled by public authorities.

Under the Qisas and Diyat framework:

the victim’s legal heirs acquired significant legal rights;
the law recognised both public and private dimensions of homicide;
victims’ families obtained statutory rights relating to Qisas, waiver, compromise, and Diyat, subject to the applicable legal provisions.

This shift represented one of the most significant changes in Pakistan’s criminal justice system.

Criminal Law (Amendment) Act, 1997

The 1990 Ordinance was initially promulgated as a temporary presidential ordinance and was re-promulgated several times.

In 1997, Parliament enacted the Criminal Law (Amendment) Act, permanently incorporating the Qisas and Diyat provisions into the Pakistan Penal Code.

Sections 299 to 338 of the Code were substantially rewritten to reflect the new legal framework.

Since then, these provisions have remained the foundation of Pakistan’s homicide law, although they have been supplemented by later legislative amendments and judicial interpretation.

The New Structure of Homicide under Pakistani Law

The reformed law classifies homicide into distinct categories, each carrying different legal consequences.

Critics have expressed concerns regarding:

unequal bargaining power during compromises;
misuse of forgiveness provisions in intra-family killings;
the interaction between private compromise and the public interest;

Successive legislative amendments and judicial decisions have attempted to address some of these concerns while preserving the essential framework of the Qisas and Diyat system.
